1. General Information

These Terms and Conditions govern the use of the Online Shop and the conclusion of sales contracts between the Seller and Customers.
Where the Customer is a Consumer within the meaning of applicable mandatory consumer protection laws, these mandatory provisions shall prevail over any conflicting provision of these Terms and Conditions.
2. Definitions
For the purposes of these Terms and Conditions:
Seller means Entropy Studio Olivier Nowakowski, operating under the brand name entropy studio.
Online Shop means the online shop operated by the Seller and available at https://entropystudio.pl/.
Customer means any person purchasing or intending to purchase Products through the Online Shop.
Consumer means a natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or professional activity.
Business Customer means a natural person, legal entity or partnership acting in the course of its trade, business or professional activity.
Product means a movable item offered for sale through the Online Shop.
Order means the Customer's declaration of intent to purchase one or more Products from the Seller.
Sales Contract means the contract concluded between the Seller and the Customer for the purchase of one or more Products.
Account means a customer account created in the Online Shop which enables the Customer to use additional functions of the Online Shop.
Payment Method means a payment method made available by the Online Shop.
3. Scope of Application
The Seller operates the Online Shop and offers Products for sale through the Online Shop.
Customers may purchase Products displayed on the Online Shop and, where available, create and use an Account.
These Terms and Conditions govern:
1. access to and use of the Online Shop;
2. the creation and use of Customer Accounts;
3. the ordering and purchase of Products;
4. payment and delivery;
5. returns and withdrawal;
6. statutory rights in the event of defective or non-conforming Products; and
7. other rights and obligations of the Seller and Customers.
The Seller does not sell Products anonymously. Customers must provide the information necessary to process their Orders.
The technical requirements for using the Online Shop are a device with Internet access, a standard web browser and an active e-mail address.
All prices displayed in the Online Shop are gross prices and include applicable statutory VAT, unless expressly stated otherwise.
4. Customer Account
The Customer may create an Account in the Online Shop where this functionality is available.
The Account may be created by logging in through a supported Google account or by using an e-mail address and password.
Upon successful registration, an agreement concerning the provision of the Account service is concluded between the Seller and the Customer for an indefinite period.
The Customer may terminate the Account agreement at any time by deleting the Account or by contacting the Seller.
The Account is provided free of charge.
The Seller may store information associated with the Customer's Account, including Customer details and Order history.
Where the Online Shop enables such functionality and the Customer voluntarily provides the relevant information, payment information may also be stored by the relevant payment service provider. The Seller does not store complete payment card details unless expressly stated otherwise in the Privacy Policy.

5. Placing an Order
The Online Shop accepts Orders 24 hours a day, seven days a week, subject to temporary interruptions caused by maintenance, technical problems or other circumstances beyond the Seller's reasonable control.
Orders may be placed with or without creating an Account.
To place an Order, the Customer shall:
1. select the desired Product;
2. select the relevant size or other available variant, where applicable;
3. add the Product to the shopping cart by clicking "Add to Cart" ;
4. review the contents of the shopping cart;
5. enter a promotional or discount code, if applicable;
6. provide the information required for processing and delivering the Order;
7. select an available delivery method;
8. select an available Payment Method;
9. review the Order details, including the total price and delivery costs;
10. accept these Terms and Conditions; and
11. submit the Order using the button indicating an obligation to pay.
Before submitting the Order, the Customer may review and correct any input errors.
The Customer is responsible for providing accurate and complete information.
If the information provided is insufficient or incorrect and prevents the Seller from processing or delivering the Order, the Seller may contact the Customer to obtain the necessary information.
6. Conclusion of the Sales Contract
The display of Products in the Online Shop does not constitute a legally binding offer by the Seller but constitutes an invitation for the Customer to submit an Order.
By submitting an Order, the Customer makes a binding offer to conclude a Sales Contract for the Products contained in the Order.
The Seller shall confirm receipt of the Order by e-mail.
The automated confirmation of receipt of an Order does not in itself constitute acceptance of the Customer's offer unless expressly stated otherwise.
The Sales Contract shall be concluded when the Seller accepts the Customer's Order by e-mail or otherwise expressly confirms acceptance.
If the Seller is unable to accept the Order, the Customer shall be informed accordingly and any payment already made shall be refunded without undue delay.
The Seller reserves the right to refuse an Order where:
- the Product is unavailable;
- the information provided by the Customer is materially incorrect;
- delivery of the Product is impossible;
- there is a technical or pricing error; or
- other legitimate circumstances prevent fulfilment of the Order.
7. Prices and Payment
The applicable price is the price displayed in the Online Shop at the time the Customer submits the Order.
The total price, including applicable taxes and delivery costs, shall be displayed before the Customer submits the Order.
The Customer shall bear the delivery costs unless the Online Shop expressly states otherwise.
Payment must generally be made before the Order is processed.
The Online Shop may offer various online Payment Methods. The currently available Payment Methods shall be displayed during the checkout process.
Payments may be processed by external payment service providers.
The Customer may be required to accept the terms and conditions of the relevant payment service provider.
The Seller is not responsible for payment failures caused by the payment service provider, the Customer's bank, card issuer or other third-party payment infrastructure, unless the failure is attributable to the Seller.
8. Delivery
Products shall be delivered using the delivery methods displayed in the Online Shop at the time the Order is placed.
The available delivery methods and applicable delivery costs shall be displayed during checkout.
The Seller shall prepare the Order for dispatch within 3 business days , unless a different processing time is expressly stated for a particular Product.
The delivery period begins after conclusion of the Sales Contract and, where payment in advance is required, after receipt of payment.
The Seller shall inform the Customer by e-mail once the Order has been dispatched.
If a Product cannot be delivered due to circumstances for which the Seller is responsible, the Seller shall inform the Customer without undue delay and refund any payments already made for the affected Product.
9. Transfer of Risk
For Consumers, the risk of accidental loss or accidental damage to the Products shall transfer to the Consumer only when the Products are delivered to the Consumer or to a third party designated by the Consumer other than the carrier.
Any mandatory statutory provisions concerning the transfer of risk shall remain unaffected.
For Business Customers, the statutory provisions concerning the transfer of risk shall apply.
10. Statutory Rights in the Event of Defects
The Seller shall be liable for defects in Products in accordance with the mandatory statutory provisions applicable to the Sales Contract.
For Consumers, the statutory provisions on liability for defects under German law ( Sachmängelhaftung ) shall apply where German law is applicable.
A Product is defective if it does not meet the agreed or objectively required characteristics or otherwise fails to comply with the statutory requirements applicable to the contract.
In the event of a defect, the Consumer may have statutory rights including, depending on the circumstances:
- subsequent performance ( Nacherfüllung );
- removal of the defect or replacement delivery;
- reduction of the purchase price ( Minderung );
- withdrawal from the contract ( Rücktritt ); and
- damages or reimbursement of expenses where the applicable statutory requirements are met.
The specific remedy available shall be determined in accordance with the applicable statutory provisions.
Consumers are not required to use a particular complaint form in order to exercise their statutory rights.
However, for efficient processing, the Seller recommends that Customers provide:
- the Order number;
- the Customer's name;
- a description of the defect or lack of conformity;
- photographs where appropriate; and
- the remedy requested, where applicable.

Where a return of the Product is necessary, the Seller shall provide the Customer with appropriate return instructions.
The Seller shall bear the statutory costs associated with remedying a defect where required by applicable law.
Nothing in these Terms and Conditions limits or excludes mandatory statutory rights of Consumers.
11. Consumer Right of Withdrawal
Consumers generally have a statutory right of withdrawal in respect of distance contracts.
The withdrawal period is generally 14 days .
For contracts concerning the purchase of goods, the withdrawal period generally begins on the day on which the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the goods.
In the case of delivery of several goods as part of one Order, the withdrawal period may begin upon receipt of the last goods, in accordance with applicable statutory provisions.
The Consumer is not required to provide a reason for exercising the right of withdrawal.
To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by means of a clear statement.
The withdrawal may be communicated, for example, by e-mail to:
A Consumer may use the model withdrawal form provided by the Seller, but is not required to use that form unless mandatory law provides otherwise.
Simply returning the goods without an express withdrawal statement may not constitute a valid exercise of the right of withdrawal.
The Consumer shall send or return the goods to the Seller without undue delay and, in any event, no later than 14 days from the day on which the Consumer notified the Seller of the withdrawal.
The deadline shall be met if the Consumer dispatches the goods before the expiry of the 14-day period.
The Seller shall reimburse the Consumer for payments received, including the standard delivery costs paid by the Consumer for the original delivery, subject to the statutory provisions governing reimbursement of delivery costs.
The Seller shall not be required to reimburse additional costs resulting from the Consumer having selected a delivery method other than the least expensive standard delivery method offered by the Seller.
The Seller may withhold reimbursement until the goods have been returned or the Consumer has provided evidence that the goods have been dispatched, whichever occurs earlier, unless otherwise required by mandatory law.
The Consumer shall bear the direct costs of returning the goods unless the Seller has expressly agreed to bear such costs or applicable mandatory law provides otherwise.
The Consumer may be liable for a reduction in the value of the goods where the reduction results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
12. Exclusions from the Right of Withdrawal
The statutory right of withdrawal does not apply in cases where an applicable statutory exception applies.
In particular, this may include goods delivered in sealed packaging which are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery.
Other statutory exclusions or limitations of the right of withdrawal remain unaffected.
13. Withdrawal Procedure
A Consumer wishing to exercise the right of withdrawal may send a declaration to:

The declaration should clearly identify the Order and, where possible, include the Customer's name, Order number and the Products concerned.
The Seller recommends keeping proof of dispatch when returning Products.
14. Electronic Withdrawal Function
Where required by applicable German law, the Online Shop shall provide an electronic withdrawal function enabling Consumers to submit a withdrawal declaration online.
The electronic withdrawal function shall be made available in accordance with the applicable statutory requirements.
The availability or use of an electronic withdrawal function does not limit the Consumer's right to exercise withdrawal by other legally permissible means.
15. Complaints Concerning the Online Shop
Technical complaints concerning the operation of the Online Shop may be submitted by e-mail to:

- the Customer's name;
- contact details;
- a description of the problem;
- the date on which the problem occurred; and
- any information necessary to identify the relevant Order or Account.
The Seller shall process complaints within a reasonable period and shall inform the Customer of the outcome.
Mandatory statutory rights remain unaffected.
16. Data Protection and Cookies
The Seller processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) and applicable German data protection law where relevant.

17. Intellectual Property
All content made available through the Online Shop, including texts, photographs, graphics, logos, trademarks, designs and other materials, is protected by applicable intellectual property laws unless otherwise indicated.
The use of such content without the prior consent of the Seller or the relevant rights holder is prohibited to the extent permitted by law.
The entropy studio name, logo and related branding may not be reproduced, distributed or commercially used without prior written consent.
18. Availability of the Online Shop
The Seller makes reasonable efforts to ensure the availability and proper functioning of the Online Shop.
Temporary interruptions may occur, in particular due to maintenance, technical failures, security incidents or circumstances beyond the Seller's reasonable control.
Nothing in these Terms and Conditions excludes or limits mandatory statutory rights relating to the availability or functionality of the Online Shop.
19. Liability
The Seller shall be liable in accordance with applicable statutory law.
The Seller shall have unlimited liability for damage resulting from intent, gross negligence, injury to life, body or health, and in other cases where mandatory statutory law requires unlimited liability.
Any limitations of liability permitted by law shall not apply where such limitations would conflict with mandatory statutory provisions or the essential contractual obligations of the Seller.
20. Amendments to the Terms and Conditions
The Seller reserves the right to amend these Terms and Conditions where there is a legitimate reason to do so, including changes in applicable law, changes in the Online Shop, technical developments or changes to services offered by the Seller.
Amendments shall not affect contracts already concluded unless otherwise permitted by mandatory law.
Customers with an Account shall be informed of material amendments in an appropriate manner, including by e-mail where required.
If an amendment requires the Customer's consent, the Customer shall be informed accordingly and the amendment shall only become effective in accordance with applicable law.
21. Applicable Law
The law of the Republic of Poland shall apply to the contractual relationship, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by applicable law.
If the Customer is a Consumer habitually resident in Germany, this choice of law shall not deprive the Consumer of the protection afforded by mandatory provisions of German law which would apply in the absence of the choice of law.
Nothing in these Terms and Conditions restricts mandatory consumer protection rights applicable in the country in which the Consumer is habitually resident.
22. Dispute Resolution
The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law or expressly agreed otherwise.
Consumers may have access to alternative dispute resolution procedures under applicable law.
The European Online Dispute Resolution (ODR) platform previously provided by the European Commission is no longer available as of 20 July 2025. References to the former EU ODR platform should therefore not be treated as an applicable dispute-resolution mechanism.
The Consumer may nevertheless have access to other applicable consumer dispute-resolution bodies or procedures under German or European law.
23. Severability
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected.
Mandatory statutory provisions shall apply in place of any invalid or unenforceable provision.
24. Final Provisions
The Seller reserves the right to introduce, amend or withdraw promotions and offers and to change Product prices.
Such changes shall not affect Orders or contracts already concluded.
These Terms and Conditions apply from 7 December 2024 .
